Overtime Meal Allowance Entitlements for CUPE Employees

SCHEDULE “A” FREQUENTLY ASKED QUESTIONS

The purpose of this document is to provide information as to when employees,  represented by the Canadian  Union of  Public Employees, Local  1505  (“CUPE” ), are eligible to receive an overtime meal allowance.

1.     Where do CUPE employees find their overtime entitlements?

Overtime eligibility and entitlements are specified at Article 15 of the Collective Agreement between the Regional Municipality of Wood Buffalo (“RMWBJ and CUPE.

2.     What is a “call out”?

A circumstance where an employee that has completed their normal shift and left the worksite and who is called out to perform overtime work. See Article 15.02 of the Collective Agreement. Also see Question 7 (below).

3.     What is an overtime meal allowance?

An employee that is called in for overtime under Article 15.02 of the Collective Agreement or required to work overtime following the completion of the employee’s regular hours of work under Article 15.07 is entitled to a fifteen dollar ($15.00) meal allowance for each meal break  that they are entitled  to. See Article 15.09 of the Collective Agreement.

4.     If a CUPE employees works overtime, what meal breaks do they receive?

Overtime meat breaks are granted in the following circumstances:

  • Where an employee is required to work overtime in excess of two (2) consecutive hours immediately prior to the commencement of the employee·s regular hours of work, the employee is entitled to a meal break without loss of pay. See Article 15.06 of the Collective Agreement.
  • Where an employee is required to work overtime, following the completion of the employees regular hours of work, which continues in excess of two (2) hours. the employee is eligible for one-half (112) hour meal break without loss of pay. See Article 15.07 of the Collective Agreement.

5.     What is “prescheduled” overtime?

Prescheduled overtime is overtime that is scheduled more than two (2) hours in advance  of  an employee’s regular hours of work or next scheduled shift. It is scheduled in accordance with Article 15.10 of the Collective Agreement and is not considered a “call out”.

6.     Who can be prescheduled for overtime?

Overtime opportunities are offered to able and qualified employees according to a rotating list in order of seniority.

Employees on sick time or annual leave are deemed not available for prescheduled overtime during the period of the absence until the next scheduled shift.

Employees on another approved leave, must notify their supervisor prior to the end of their last scheduled shift if they are available for prescheduled overtime shifts.

7.     When is a CUPE employee entitled to an overtime meal allowance?

Employees are eligible for an overtime meal allowance in the following circumstances :

  • If an employee is required to report for an overtime opportunity within two (2) hours of when an employee is contacted (including before a shift commences), it will be considered  a call out (Article 15.02). An employee will receive a meal allowance for each meal break they are entitled to.
  • If an employee finishes their shift and is called back to work that same day, it will be considered a call out (Article 15.02). An employee will receive a meal allowance for each meal break they are entitled to.
  • If an employees shift is extended, the employee will be eligible for a meal allowance if they are required to work overtime following the completion of their regular hours of work (Article 15.07).
